Change to Employment Status for Post-Doctoral Fellows in CUPE bargaining unit

You may recall (see PDAD&C#53 and 55) that a secret ballot vote was to be conducted to assess whether a majority of Post-Doctoral Fellows ("PDFs") in the bargaining unit proposed by CUPE wished to be represented by CUPE as their exclusive bargaining agent in dealing with the University.  A majority of those casting ballots voted in favour of unionization. The Ontario Labour Relations Board ("OLRB") has now issued the Certificate confirming that CUPE has exclusive bargaining rights with respect to employees in the following bargaining unit:

All persons employed as Postdoctoral Fellows by the University of Toronto in the City of Toronto and the City of Mississauga and registered as Postdoctoral Fellows with the School of Graduate Studies save and except:
1)    persons who exercise managerial functions or who are employed in a confidential capacity in matters related to labour relations;
2)    persons for whom any other trade union holds bargaining rights under the Labour Relations Act; and
3)    Postdoctoral Fellows who apply for and are awarded funding from any source other than the University of Toronto including, without limiting the generality of the foregoing, NSERC, SSHRC, CIHR, or foundations such as the Mellon Foundation.

NOTE 1:  Postdoctoral Fellows who receive their stipends through a hospital are not included in the bargaining unit.
NOTE 2:  Postdoctoral Fellows are included in the bargaining unit notwithstanding the exclusion in (3) above where:
(a)   at the time after they first commence employment with the University of Toronto as a Postdoctoral Fellow, they are receiving funding solely from the University of Toronto so as to be in the bargaining unit;
(b)   they subsequently apply for and are awarded additional funding from any source other than the University of Toronto; and
(c)   the additional funding in (b) above is less than the funding that the Postdoctoral Fellow is continuing to receive from the University of Toronto.

The OLRB had ruled on January 20, 2012 that PDFs in this kind of bargaining unit could be considered employees for the purposes of the Labour Relations Act.

Since the subset of PDFs in question have clearly indicated their intention to be represented by CUPE and no longer to be treated as independent academic trainees, the University is taking steps to ensure that PDFs who would fall within the bargaining unit will be treated as employees when they are hired and offer letters are being amended for this purpose.  With respect to existing PDFs within the bargaining unit, communication is going to all relevant Post-Doctoral Fellows to advise them of the change. 

Those PDFs who will be included within the CUPE bargaining unit must be treated as employees for the purpose of statutory deductions for Income Tax, CPP and EI.  These deductions will be made automatically from the stipend payments to PDFs in the bargaining unit, in the same manner that occurs for other employees. The University has advised CUPE that it intends to proceed to implement such required deductions very shortly.

Once CUPE has provided notice to bargain, the University will bargain in good faith and will endeavour to agree upon a first collective agreement which will set out the detailed terms and conditions of employment.  Before bargaining commences, an expert bargaining committee will be formed to represent the interests of the University, and there will be opportunities for input into the development of the bargaining mandate, as occurs with all collective bargaining at the University. It is important to keep in mind that Employment Standards Legislation does outline minimum expectations with respect to vacation entitlements, hours of work, leaves (e.g. maternity leave).

There will doubtless be questions that will arise from PDFs, PIs and others, as to the detailed implication of the changes necessitated by the choice of this group of PDFs to unionize.  SGS, HR, and Labour Relations will all be working together to provide additional information in the coming months.  In the interim, questions should be directed to the SGS Post-Doctoral Fellowship Office and they will be answered as soon as possible on a coordinated basis.

On December 31, 2014, Professor Catharine Whiteside will complete her second term as Dean of the Faculty of Medicine and Vice-Provost, Relations with Health Care Institutions.

In accordance with Section 60 of the Policy on Appointment of Academic Administrators, I am calling for nominations for the advisory committee that will advise the President on the appointment of a new Dean.  The Policy mandates the potential composition of the advisory committee as follows:

*     The Vice-President and Provost (Chair);
*     Three to five members of the teaching staff of the Faculty;
*     One to three students of the Faculty;
*     The Dean of the School of Graduate Studies or representative;
*     A librarian, where appropriate;
*     Two or three other qualified scholars from within or outside this University, but outside the Faculty;
*     In addition, the committee may include an alumnus/a, a member of the administrative staff, and a senior member of the appropriate professional community.

I am very pleased to announce that Marc Drouin has accepted the position of Director of Environmental Health & Safety (EH&S), effective September 23, 2013. 

Marc is currently the Director of the Environmental Health and Safety division – Facilities for the Université de Sherbrooke and its three campuses. In this role he has been responsible for the strategic development and successful implementation of Sherbrooke’s health and safety program. 

Marc comes to the position with a commitment to the development of a culture of safety within the academic environment and an in-depth understanding of safety issues in science and research performance requirements for universities. He believes in a collaborative, problem-solving approach and will work in partnership with our community to ensure that the University's Environmental Health & Safety practices and procedures are exemplary.

Marc holds a Masters of Science in Chemistry from McGill University and a Masters of Business and Administration from the Université de Sherbrooke.

I am confident that under the leadership of Marc and the EH&S Associate Director, Gina Trubiani, this unit will continue to develop into a leading edge group of EH&S professionals.

This year's University of Toronto's Teaching & Learning Symposium will explore a range of teaching and learning ideas, issues and possibilities related to borders and boundaries. Are real or perceived borders and boundaries changing, and if so, how? In particular, sessions will consider the how, what, where and why of teaching and learning and will focus on five major themes:

1.    The flexible classroom
Where does learning happen in today's universities? How is this impacting teaching approaches and course and curriculum design?
2.    Global citizenship
How should we/can we teach our students to be global citizens?
3.    Competencies and skills
What unique skills and competencies do instructors and students feel are important for University of Toronto graduates?
4.    Research and teaching
How does research inform our teaching and how does teaching inform our research? What are innovative strategies for bridging research and teaching to enhance student learning?
5.    Teaching alone, teaching together
What new models are emerging that capitalize on individual and team-based approaches to teaching?

This tri-campus event is intended to stimulate discussion and the sharing of practical, successful experiences around teaching and learning, aiming to enhance communications and build internal networks. It is a cross-divisional forum that allows faculty and staff to explore and share new instructional methods, to celebrate our commitment to teaching and learning, and to hear from this year's recipients of the President's Teaching Award.  The symposium will include a featured speaker, a special session featuring the 2013 President's Teaching Award recipients and the President, interactive concurrent sessions, "Welcome to my classroom" sessions delivered by the 2013 President's Teaching Award winners, and sessions featuring nifty assignments and lightning talks on effective teaching strategies.

SESSION PROPOSAL FORMATS:
We invite session proposals, from UofT faculty and staff, in one of the following formats that address any of the five themes outlined in this call:

1.    Interactive Concurrent Sessions (50 minutes):
These sessions will focus on the presentation of creative teaching approaches or strategies that have evidence of effectiveness as demonstrated through assessment, research or successful practice.  Please specifically describe the methods you will use to foster interactivity among the participants and presenters.
2.    Nifty Assignment Sessions (15 minute time slots; 50 minute session): 
These sessions will offer a series of short (15 minute) presentations that introduce "nifty" assignments currently used in University of Toronto classrooms. Presenters will provide details regarding the student learning goals for the assignment, the development and administration of the assignment, discuss strengths and challenges and provide examples of successful implementation.  (Note: 3 individual presenters will be grouped together for one session; group submissions on a particular theme are welcome.)


3.    Teaching Strategies: Lightning Talks (5 minute time slots; 50 minute session)
Up to 6 individuals will be selected for each "Lightning Talk" session. Each presenter will have 5 minutes to present an effective teaching strategy to the audience. Presenters should briefly describe the strategy and provide evidence of its effectiveness (gathered through informal observation or more formal study). Each presenter may use a maximum of three power point slides to illustrate the presentation of the teaching strategy. Time will be allotted at the end of the session for Q&A.

The session will take place at the Faculty Club from 8:45 a.m. - 12:00 p.m. Previous workshops have been very highly rated by participants.

Ruth Reimer from Green, Chencinski, Starkman and Eles (GCSE) will provide a workshop session which will introduce the process of filing taxes in Canada and discuss some of the details of filing in both Canada and the US. Time will also be allowed for discussion, questions and answers. Some faculty members may also wish to arrange more individualized consultation with GCSE at their own cost.

Special Joint Advisory Committee Process Update Statement, July 2013

In recent months, representatives of the University of Toronto Governing Council and the University of Toronto Faculty Association (UTFA) have been engaged in formal discussions regarding modernization of the Memorandum of Agreement (MoA) governing the relationship between the two parties.

Specific topics being considered in addition to changes to the MoA include tenure and promotion policies; appointment policies for teaching stream faculty and faculty whose expertise lies in the integration of their professional practice with teaching; and the role of faculty and librarians in academic planning.

These discussions originate in a mediation agreement signed in April of 2012 establishing a Special Joint Advisory Committee (SJAC) to review the strengths and weaknesses of the current framework agreement (i.e., the MoA) between UTFA and the Governing Council of the University, and to consider ways to modernize it. The MoA was originally established in the late 1970s and prescribes the formal role of UTFA in representing faculty and librarians at the University. It has played an important role in the life of the University. The MoA features a collective bargaining process for addressing compensation matters, including independent arbitration for these matters if the parties are unable to reach voluntary agreement. It also articulates a set of primarily academic policies that are neither subject to arbitration nor to any prescribed negotiating process under the MoA, but that may only be changed by mutual consent of the Governing Council and UTFA. 

Formal discussions commenced in early April of 2013 and we have been meeting regularly since that time. Discussions have been substantive and collegial and we are committed to continuing the process. Now, owing largely to scheduling difficulties over the summer, the two sides have agreed to adjourn talks until September. The parties have also proposed to extend the original September 2013 deadline for the SJAC process to April 1, 2014 to allow time for a complete discussion of all the issues and options to take place. Formal agreement to the extension is pending.


By mutual agreement of UTFA and the Governing Council, The Honourable Frank Iacobucci has agreed to serve as a facilitator in the SJAC process, should such assistance be necessary. Mr. Iacobucci is a former Justice of the Supreme Court of Canada, former Dean of the University of Toronto Faculty of Law and former Interim President of the University of Toronto.

The Banting Postdoctoral Fellowships Program, administered by CIHR, NSERC and SSHRC, is intended to
attract and retain top-tier postdoctoral talent, both nationally and internationally; develop their leadership potential; and position them for success as research leaders of tomorrow, positively contributing to Canada's economic, social and research-based growth through a research-intensive career. Seventy fellowships will be awarded each year, divided evenly between Canada's three federal granting agencies (CIHR, NSERC and SSHRC). When the program is fully implemented, there will be 140 awards active at any one time.

The Banting Postdoctoral Fellowships program is unique in its emphasis on the synergy of research goals and projects between the following:
·         applicant – individual merit and potential to launch a successful research-intensive career
·         host institution – commitment to the research program and alignment with the institution's strategic priorities

Value and Duration
$70,000 per year (taxable) for two years.

Faculty Allocation
Each Faculty will receive an allocated number of applications (based on post-doctoral fellow population) that may be put forth and endorsed as candidates for the Banting PDF. Faculties are asked to provide a ranked list of applicants, included in their allocation to the Graduate Awards Office by October 2, 2013 (details below).

Applicants for the 2013–14 Banting Postdoctoral Fellowships program must fulfill or have fulfilled all degree requirements for a PhD, PhD-equivalent or health professional degree:

·         On a date within the eligibility window of October 23, 2010 through December 31, 2013. Applicants who have not fulfilled all requirements for their degree at the time of application must do so no later than December 31, 2013 and submit proof no later than January 15, 2014. Applicants who do not submit such proof will be automatically withdrawn from the competition.

·         No earlier than October 23, 2008 if they have had their career interrupted or delayed for the purpose of childrearing, illness, or health-related family responsibilities or, for health professionals only, have engaged in post-degree non-research related clinical training (residency, etc).

  1. The Banting application is initiated by the applicant through the ResearchNet Application System with the CV data components created using the Common CV system.
  2. Applicants should first contact their supervisor to request the support of their application and if granted, inquire about the specific nomination/selection process and associated deadlines implemented by their Faculty Research Office.
  3. Candidates who have successfully received a nomination by their Faculty will receive the endorsement of the university and will be provided with the final institutional support documents required to successfully complete the application process.

  1. Candidates are responsible for uploading all required documents to ResearchNet to complete the application and submission process. Only the referee assessment forms are to be completed and submitted online by the referees. It is the applicant’s responsibility to ensure that all documents are included by the deadline of November 1, 2013 at 8:00 p.m. (EDT).
  2. Candidates must obtain (from the institution that conferred their degree) a Fulfillment of Degree Requirements Form and include this completed document with their application. Applicants who require this form from UofT must request it by email from SGS by Oct 18th; see SGS website for details

1.      Supervisors wishing to support a candidate’s application should contact their affiliated Faculty Research Office to inquire about the Faculty’s internal deadline, application and selection process.
  1. Each Faculty will receive an allocated number of applications (based on post-doctoral fellow population) that may be put forth and endorsed as candidates for the Banting PDF and are asked to carefully select and endorse only the highest quality applicants from both Canada and abroad within that allocation.
  2. The Faculty Offices will receive and evaluate applications, selecting candidates in accordance with the stated Selection Criteria, for whom they wish to offer support and have receive the institutional support documents required to successfully complete the application process.

All applications endorsed by a given host institution must be signed by the same official signatory, as such the Institutional Synergy and Letter of Endorsement Letter, must be printed on SGS letterhead and signed by Brian Corman, Dean of Graduate Studies and Vice-Provost, Graduate Education.
Accordingly we ask all Faculties to provide the following information to the Graduate Awards Office by October 2, 2013:
1.      A list of all applications received, providing supervisor name and graduate unit affiliation for each. Only those selected as candidates to be included in your allocation should be ranked. 
2.      An electronic copy (saved as MS Word doc) of the Institutional Synergy and Letter of Endorsement Letter, prepared for each ranked candidate included as part of your allocation. This text will be included in the formal institutional support letter and will receive the Dean’s signatory.

Bloomberg Faculty of Nursing, from August 1, 2013 to July 31, 2014, or until the appointment of a new Dean. Professor McGillis Hall has served as Associate Dean, Research & External Relations since 2007, and served as Acting Dean in 2011. Nominators emphasized her excellent experience in senior leadership as well as her decision-making skills and knowledge of the Faculty. A recognized leader in health services research in nursing, Professor McGillis Hall has received numerous honours, including: induction into the Canadian Academy of Health Sciences and the American Academy of Nursing, grants and career awards from the Canadian Institutes of Health Research and the Ministry of Health and Long-Term Care, and a Premier's Research Excellence Award. Prior to joining the Faculty of Nursing, Professor McGillis Hall completed a Baccalaureate in Administrative Studies at York University, a PhD in Nursing Administrative Science and a Medical Research Council-funded Postdoctoral Fellowship with the Department of Health Policy, Management and Evaluation at the University of Toronto. Professor McGillis Hall's academic research interests are in the area of health human resources, the nursing work environment, nurse migration, and patient safety outcomes of nursing practice. She has published numerous peer-reviewed articles and book chapters and edited a book on Quality Work Environments for Nurse and Patient Safety. I am delighted to announce that at its meeting yesterday, the Governing Council of the University of Toronto approved the establishment of the Dalla Lana School of Public Health as a Faculty as of July 1, 2013.  It has been more than 15 years since the creation of a new Faculty at the University of Toronto, making this a truly historic occasion for the University.

The Dalla Lana School of Public Health is a global leader in public health education, research and service.  It offers doctoral and masters programs across seven areas of study to nearly 400 students, and trains the next generation of educators, scientists and practitioners who will advance public health in Canada and around the world.  The School's new status as a Faculty will enhance its ability to compete for the best faculty, students, and research funding, as well as enable it to reach its full potential in addressing the complex challenges facing the health of populations locally and globally in the 21st century. 

Professor Hu has served as Director of the Dalla Lana School of Public Health since July 2012, and his position now becomes that of Dean.  Professor Hu is a physician, board-certified in internal medicine and occupational/environmental medicine, who also holds a doctoral degree in epidemiology.  Prior to joining the University of Toronto, he held positions at the University of Michigan Schools of Public Health & Medicine and the Harvard School of Public Health. 

Please join me in congratulating the faculty, staff, and students of the Dalla Lana School of Public Health on this important milestone, and in welcoming Professor Howard Hu to his role as Dean of the new Faculty.

Professor Brian Corman will complete his term as Dean of the School of Graduate Studies on June 30, 2014. Dean Corman is eligible for re-appointment.

In accordance with Section 61 of the Policy on Appointment of Academic Administrators, I am writing to call for nominations of individuals to serve on the advisory committee that will advise the President on the appointment of a Dean.

The Policy on Appointment of Academic Administrators mandates the composition of the advisory committee as follows:

*     The Vice-President and Provost (Chair);
*     One member of the teaching staff from each of the divisions of the School of Graduate Studies;
*     One Dean of a Faculty or School;
*     One Chair of a graduate department;
*     One Director of a graduate Centre or Institute;
*     One to three graduate students; and
*     A librarian, where appropriate.
*     In addition, the committee may include an alumnus/a, a member of the administrative staff, and a qualified individual from outside the    University.

In keeping with the University's established practice of conducting divisional reviews at the end of a Dean's term, the advisory committee will review the progress made by SGS towards meeting the goals of the Towards 2030 framework (including The View from 2012) and the recommendations of the 2005 Task Force on Graduate Education. The School will conduct a self-study that will be considered by the advisory committee in their review. The advisory committee will begin meeting this fall.
